By purchasing this physical print, you acquire ownership of the physical object only.

All intellectual property rights, copyrights, and reproduction rights remain exclusively with the Artist. This purchase does not grant permission to scan, digitise, duplicate, or reproduce the artwork in any format.

Commercial use, modification, and digital minting—including but not limited to the creation of Non-Fungible Tokens (NFTs), crypto-art, or digital assets representing this artwork—are strictly prohibited. Unauthorised digital replication or commercial distribution will be treated as copyright infringement and prosecuted to the full extent of the law.

These terms govern both your use of our website and, where applicable, your purchase of artwork, prints and other products from us. Please read them carefully before using our site or placing an order.

PART A: USE OF OUR WEBSITE

1.  About us and how to contact us

Stuart Beck Artist (trading as stubeckstudio) is a sole trader selling original artwork and prints online.

2.  By using our site you accept these terms

By using our site, you confirm that you accept these terms and that you agree to comply with them. If you do not agree to these terms, you must not use our site.

3.  Other terms that apply to you

These terms refer to the following additional terms, which also apply to your use of our site:

If you purchase products from our site, Part B of these terms (Terms and Conditions of Sale) also applies.

4.  Changes to these terms 

We may amend these terms from time to time. Every time you wish to use our site, please check these terms to ensure you understand the terms that apply. 

5.  Availability of our site

Our site is made available free of charge. We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

6.  How you may use material on our site

We are the owner or licensee of all intellectual property rights in our site and in the artwork, images and other material published on it. Those works are protected by copyright laws and treaties around the world.use any part of the content on our site for commercial purposes without obtaining a licence to do so from us.

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link that suggests any association, approval or endorsement on our part where none exists. Our site must not be framed on any other site. We reserve the right to withdraw linking permission without notice.

7.  No text or data mining, or web scraping

You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to our site or any services provided via, or in relation to, our site. This includes the use of any automated device, program, tool, algorithm, code or methodology to access, obtain, copy, monitor or republish any portion of our site or any data, content or information accessible via it.

8.  Third party websites

Where our site contains links to other sites and resources provided by third parties, those links are provided for your information only. We have no control over the content of those sites or resources and accept no responsibility for them.

9.  Viruses and security

We do not guarantee that our site will be secure or free from bugs or viruses. You are responsible for configuring your own technology to access our site and should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other malicious or harmful material. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site.

10.  Our liability for use of our site

We do not exclude or limit our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors, and for fraud or fraudulent misrepresentation.

To the extent permitted by law, we exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it. We will not be liable for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising in connection with your use of, or inability to use, our site or any content on it.

PART B: TERMS AND CONDITIONS OF SALE

These terms apply when you purchase Goods through our site. They apply alongside Part A above.

11.  Key definitions

In these terms the following words have the meanings set out below:

Bespoke Order - An order for Goods made to your specifications, including custom sizes, personalised prints, bespoke framing or mounting.

Goods - Artwork, art prints, frames and any other items we supply to you following your Order.

Order - Your request to purchase Goods from us, placed through our site.

Standard Print - A print offered in a standard size and specification from our site, fulfilled by theprintspace.

We / us / our - Stuart Beck Artist (trading as stubeckstudio).

You / your - The person placing an Order on our site as a consumer customer.

12.  Our contract with you

Placing an Order on our site does not create a contract between us. A contract is only formed when we send you an order confirmation email accepting your Order.  These terms and conditions govern our contract with you for your Order.

We may sometimes reject an Order, for example, if a product is unexpectedly out of stock, your payment cannot be processed, or there has been a pricing error on our site. If we reject your Order we will tell you as soon as possible and refund any payment you have already made.

We will confirm the key details of your Order to you in writing in our order confirmation email.

By placing any order with us, you confirm that you are at least 18 years old and are legally capable of entering into binding contracts.

13.  Our products

13.1  Standard Prints

Colours and dimensions shown on our site are as accurate as we can make them, but the true colour of a print may vary slightly from how it appears on your screen, and sizes may vary marginally from those stated. These are not defects.

13.2  Bespoke Orders and additional extras (including framing)

We may offer bespoke options including custom sizes, framing and mounting, either as part of a print order or as an added extra. If you wish to place a Bespoke Order, please contact us at stubeckstudio@gmail.com before ordering so we can confirm availability, lead times and pricing.

For Bespoke Orders we will confirm the full specification, price and estimated lead time in writing before you proceed. Once you approve the specification and we have accepted your Order, production will begin and changes cannot be accepted.

Bespoke Orders are not eligible for cancellation under your right to change your mind (see clause 16), as they are made to your specifications. Your statutory rights in respect of damaged or faulty Goods are not affected.

For framed or mounted Goods shipped to EU or non-UK destinations, customs duties may apply on bespoke handmade frames or mounting. We will advise you where applicable.

14.  Price and payment

Prices are shown on our site in pounds sterling (GBP). 

Delivery charges are shown separately at checkout. The total amount payable, including any delivery charge, will be confirmed before you submit your Order.

Payment is taken at the time you place your Order, by the methods shown at checkout. Payment is processed securely by Squarespace’s integrated payment processor. We do not store your payment card details.

If we are unable to collect payment, we will not fulfil your Order and will contact you to resolve the matter.

15.  Delivery

15.1  How we deliver

Standard Prints and framed prints are produced on demand and dispatched on our behalf by theprintspace, normally within 1-5 working days of your Order being confirmed. Bespoke Orders may be dispatched by different service providers; dispatch times will be confirmed in your order confirmation.

Estimated delivery dates are provided at checkout on a best endeavours basis and are not guaranteed. Once your Order has been dispatched, we will provide tracking information where available.

15.2  Delivery address

Please ensure your delivery address is accurate when placing your Order. We cannot be responsible for failed or delayed deliveries caused by an incorrect address you have provided.

15.3  UK and international delivery

We deliver within the UK and internationally. For orders where customs duties apply, it will be the recipient’s responsibility unless we have stated otherwise.

15.4  Delays outside our control

Delivery of your Goods may be delayed by an event outside our control (such as postal disruption, severe weather, or customs processing).  In such circumstances, we will do what we can to minimise the delay. 

16.  Your right to cancel

16.1  Standard Prints 

As a consumer purchasing Goods online you have a legal right to cancel your contract within 14 days of receiving your Goods (the cancellation period), without giving any reason. This right does not apply to Bespoke Orders (see clause 16.2 below).

To exercise your right to cancel, please contact us clearly within the cancellation period by emailing stubeckstudio@gmail.com

If your Goods have already been dispatched or delivered, you must return them to us within 14 days of telling us you wish to cancel. You are responsible for the cost of returning the Goods to us (unless the Goods are faulty - see clause 17). Goods must be returned in their original condition and packaging. We may reduce your refund to reflect any reduction in the value of the Goods caused by the way you have handled them.

  1.  Bespoke Orders

Your right to cancel does not apply to Bespoke Orders - Goods made to your specifications or clearly personalised (including custom-sized prints, bespoke framing or mounting).  If you have ordered standard and bespoke items together, the right to cancel applies only to the standard items.

16.3  Refunds on cancellation

If you cancel within the cancellation period and return the Goods to us, we will refund the price of the Goods. We will process your refund within 14 days of receiving the returned Goods (or evidence of their return), using the same payment method you used to pay.

17.  Faulty or misdescribed Goods

If your Goods arrive damaged, defective or significantly different from their description, please contact us as soon as possible at stubeckstudio@gmail.com with photographs of the issue. For print orders fulfilled by theprintspace, we will liaise with them on your behalf: they will assess the damage and, where confirmed, arrange a free replacement. Please do not return damaged Goods to us without contacting us first.

18.  Additional terms for Bespoke Orders

Where you have asked us to produce Goods to your specifications, the following additional terms apply:

  1. You are responsible for ensuring any measurements, specifications or details you provide are accurate. We are not liable for Goods that do not meet your requirements if they were made to the specifications you provided.

  2. Bespoke Orders may have longer lead times than standard orders. We will confirm the estimated lead time in writing before you place your Order.

  3. We will ask for your approval of the specification in writing before production begins. Once approved and production has started, we cannot accept changes.

  4. As noted in clause 16.2, Bespoke Orders are not eligible for return or refund under your right to cancel, unless they arrive damaged or faulty.

19.  Intellectual property in Goods

All artwork sold through our site is created by Stuart Beck Artist (trading as stubeckstudio). We retain all intellectual property rights in all the artwork on the site. The purchase of physical Goods does not transfer any intellectual property rights to you.

You may not reproduce, copy, publish or otherwise use images of artwork purchased through our site for commercial purposes without our prior written consent.

Limited edition prints will be numbered and signed where stated on the product listing. Edition numbers and certificates of authenticity will be issued as described in the relevant listing.

20.  Our liability to you for your purchase

We do not limit our liability to you in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

Subject to the above, we are not liable to you for:

  1. any loss or damage that was not reasonably foreseeable when your Order was placed;

  2. any indirect or consequential loss; or

  3. any business loss (including loss of profit or business opportunity), since our site is intended for personal consumer use only.

If we fail to comply with these terms, we shall only be liable to you for the purchase price of the Order.

21.  Governing law and disputes

These terms are governed by English law. Any dispute arising under or in connection with these terms will be subject to the exclusive jurisdiction of the courts of England and Wales.

If you have a complaint about your Order, please contact us first at stubeckstudio@gmail.com and we will do our best to resolve it. If we cannot resolve a complaint directly, you may refer it to an alternative dispute resolution (ADR) scheme. We will provide details of available schemes on request.  You may also use the European Commission’s Online Dispute Resolution platform at http://ec.europa.eu/consumers/odr/ (primarily for EU-based consumers).

22.  Other important terms

We may transfer our rights and obligations under these terms to another organisation and will notify you if this happens. The transfer will not affect your rights under the contract.

Each clause of these terms operates independently. If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply. These terms constitute the entire agreement between us in relation to your use of our site and your purchases from us.
